Terms of service for clients engaging Cromwell Electrical Pty Ltd.

In these Terms & Conditions, "we", "us" and "our" refers to Cromwell Electrical Pty Ltd (ABN 99 698 816 036, ACN 698 816 036). "You" and "your" refers to the client or customer engaging our services. The "Company" means Cromwell Electrical Pty Ltd.
These Terms & Conditions govern all electrical services provided by the Company to you. By engaging our services, you agree to be bound by these terms. They apply to the exclusion of any other terms unless expressly agreed in writing.
All quotations provided by the Company are valid for 30 days from the date of issue unless stated otherwise. Quotations are based on the information available at the time and may be revised if additional work is required or site conditions differ materially from those represented.
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. The ACL provides statutory consumer guarantees, including that services will be provided with due care and skill, be fit for purpose, and be completed within a reasonable time. Nothing in these terms purports to exclude, restrict or modify the application of the ACL or your rights under it.
To the maximum extent permitted by law, the Company's liability for any claim arising out of or in connection with the supply of services is limited, at our option, to re-supplying the services or paying the cost of having the services re-supplied. The Company is not liable for any indirect, incidental or consequential loss or damage, including loss of profits, revenue or business interruption, however caused.
Payment terms will be specified in each quotation or invoice. Unless otherwise agreed, payment is due within 14 days of the invoice date. The Company reserves the right to suspend work or charge interest on overdue amounts at the rate prescribed by law.
Any designs, drawings, specifications or other intellectual property prepared by the Company in connection with its services remain the property of the Company unless otherwise agreed in writing. You are granted a licence to use such materials for the intended purpose of the project only.
Either party may terminate an engagement by giving 14 days' written notice. The Company may terminate immediately if you fail to comply with these terms or if payment is overdue. Upon termination, you must pay for all services rendered up to the date of termination.
You agree to provide safe and reasonable access to the site for our personnel. You must notify us of any known hazards or site-specific safety requirements. The Company reserves the right to suspend work if site conditions pose an unreasonable safety risk.
These Terms & Conditions are governed by and construed in accordance with the laws of the State of Victoria, Australia. The parties submit to the exclusive jurisdiction of the courts of Victoria.
The Company reserves the right to modify these Terms & Conditions at any time. Updated terms will be published on this page. Continued engagement after changes constitutes acceptance of the revised terms.
